For the appointment of Bank Charge Solutions - Important Information

Definitions:

Bank Charge Solutions: the firm appointed to provide services on behalf of the client in the pursuit of a claim for unlawfully applied charges.
The Client: the person for whom Bank Charge Solutions has been instructed to provide such services.
The Company: the Bank, Financial Institution or Account Provider.
The Claim: services provided to make a claim for unlawfully applied pentalty charges against the banking institution or credit provider.

Service:
The client has appointed Bank Charge Solutions to provide services in the pursuit of a claim for unlawfully applied bank charges with accrued interest.

Bank Charge Solutions will:
  • Evaluate a potential claim due to the Client in respect of the unfair charges applied to their account.
  • Negotiate and settle the claim with the bank or account provider on a NO WIN - NO FEE basis.
  • Use best endeavours to win back your claim with full interest.
  • Promptly notify the client of the successful outcome of the complaint.
  • Act always in good faith on behalf of the Client.
  • Comply with appropriate Codes of Practice.
  • Preserve all confidentiality, trating personal information as private and confidential (even when you cease to be a customer). You have the right of access under the Data Protection Act, 1998, to your personal records held on our files.
  • Use all reasonable skill and care in the performance of your claim, whilst reserving the right not to undertake the Claim.
  • Instruct a solicitor to act on your behalf in the event the bank wish to take your claim to court.
The Client will:
  • By completing and signing the Form of Authority, give Bank Charge Solutions full authority to deal with the Company on the Client's behalf.
  • Deal promptly with all reasonable requests by Bank Charge Solutions for information or documents in support of their claim and inform Bank Charge Solutions of any relevant matters affecting the claim.
  • Agree to give Bank Charge Solutions exclusive rights to action the Claim.
  • If the Company settles directly with the Client, the Client will forward Bank Charge Solutions' fees within 10 days of the cleared funds.
Fee Payable by Client: 27.5%. There are no hidden charges or upfront fees.

Our services:
Bank Charge Solutions will prepare and submit a claim to your bank/account provider, and if they will not pay out, Bank Charge Solutions will instruct a solicitor to further your claim in court. Please note our service takes approximately 15 weeks.

What are the risks?:

Bank Charge Solutions operate on a NO WIN - NO FEE basis. You will not be liable to pay the bank's costs, even if you lose.

Alternative free services available to you:

You may be able to recover penalty charges by writing directly to your bank, or by using the service offered by the 'Financial Ombudsman Service', or by using other self help letters and processes offered by consumer groups
e.g. 'Which?'.

Can I think about it?:
Bank Charge Solutions want our clients to be entirely happy with our service. Please take as much time as you need to consider your alternatives, and contact us if you have any questions. However, please be aware that you will not be able to recover penalty charges applied more than six years before the date you sign the documents. This offer may be withdrawn 30 days after the date of this letter if it has not been signed and returned by you.

Cooling off period:

If you sign this agreement, you have 14 days to change your mind and cancel the agreement should you wish to for any reason. In this event please telephone us. The 14 day period begins on the date you sign it. You agree we can commence providing you with this service as soon as it is signed by you.

Cancellation:

You can withdraw from this agreement at any time. After the 14 day cooling off period has ended, then you will be liable to pay our reasonable costs up to the maximum of the agreed fee.
